PRIVACY POLICY

FenceQuoter LLC

Effective Date: October 1, 2026

This Privacy Policy is intended to be read alongside the company's Terms of Service, which governs the contractual relationship with paying contractor tenants. Where the two documents both touch contractor data, the Terms of Service controls the business relationship and this Policy explains data handling.

1. Introduction and Scope

FenceQuoter LLC (“FenceQuoter,” “we,” “us,” or “our”) is a Minnesota limited liability company that operates a software platform used by fence-installation contractors (“Contractors”) to generate instant fence estimates for homeowners and property owners through an AI-assisted estimation tool (the “Widget”) and to manage related leads, scheduling, and billing (together, the “Service”).

This Policy describes how we collect, use, and share personal information in connection with the Service, and applies to two groups of people:

  • Widget Users, homeowners and property owners who interact with the Widget, whether it is embedded on a Contractor's own website or hosted on a Contractor's page at fencequoter.app, to receive a fence estimate, request a quote, or schedule an appointment.
  • Contractor Accounts, the individuals who create and manage a Contractor's account on the Service (for example, a business owner or office staff member).

This Policy does not apply to a Contractor's own website, marketing materials, in-person sales practices, or any other activity outside the Service itself, those are the Contractor's own responsibility.

2. Information We Collect

2.1 From Widget Users (Homeowners)

  • Contact information you provide: name and phone number.
  • Property information: property address and ZIP code.
  • Photographs of your property that you voluntarily upload to receive an estimate.
  • Mapping and location data: the fence-line boundary you trace on a satellite map, and any obstacles you mark for removal or retention.
  • Estimate and scheduling details: material preferences, selected appointment times, and related notes.
  • Messages you send us, and any information you include in them.

2.2 From Contractor Accounts

  • Business information: business name, service area ZIP codes, and the pricing rates a Contractor configures.
  • Account credentials: email address and password (stored using industry-standard hashing, never in plain text).
  • Billing information: subscription and payment details, processed directly by our payment processor, Stripe. FenceQuoter does not directly store full payment card numbers.
  • Mobile phone number, where a Contractor enables SMS lead notifications.

2.3 Automatically Collected Information

  • Standard technical data such as IP address, browser type, device type, and pages visited, collected for security and diagnostic purposes.
  • Local browser storage and similar technologies, described further in Section 8.

3. How We Use Information

  • To operate the Widget and generate fence estimates.
  • To connect a Widget User with the specific Contractor whose page or embedded Widget they used.
  • To facilitate scheduling of in-person walkthroughs and appointments.
  • To process Contractor subscription billing through Stripe.
  • To send Contractors notifications about new leads (see Section 9).
  • To detect, investigate, and prevent fraud, abuse, and misuse of the Service.
  • To maintain, secure, monitor, and improve the Service.
  • To comply with legal obligations and enforce our agreements.

4. How We Share Information

4.1 With the Contractor You Contacted

The name, phone number, property address, photographs, traced fence-line data, and estimate details a Widget User submits through a specific Contractor's Widget are shared with that Contractor. This is the core purpose of the Service, connecting a homeowner with the Contractor whose page or embedded Widget they used, and it is not optional to the estimate/quote process.

When you submit a request, you are directing us to send your information to that Contractor so the Contractor can respond to you. After we send it, FenceQuoter and the Contractor each decide independently how to use that information, and each is responsible for its own handling of it. The Contractor's use of your information, including any call, text, or email the Contractor sends you, is governed by the Contractor's own privacy notice, not by this Policy, and is not controlled by FenceQuoter.

4.2 With Service Providers

We share limited information with third-party service providers who perform functions on our behalf, each under contractual terms limiting their use of the data to providing services to us:

  • Stripe, payment processing for Contractor subscription billing.
  • Telnyx, delivery of SMS lead notifications to Contractors.
  • Anthropic, AI-assisted analysis of uploaded property photographs (see Section 5).
  • Supabase, database hosting and account authentication.
  • Mapbox, mapping, geocoding, and satellite imagery used for address entry and fence-line tracing.
  • Vercel, web hosting and infrastructure.

4.3 We Do Not Sell or Share Your Personal Information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising, as those terms are used in state privacy laws. We do not disclose your information to any third party for that party's own marketing purposes. The disclosure to the Contractor described in Section 4.1 is made at your direction, in response to the request you submitted through that Contractor's Widget.

If you would prefer that we not sell or share your personal information, email support@fencequoter.app with the subject line “Do Not Sell or Share My Personal Information.” We honor these requests from everyone, regardless of where they live.

4.4 Other Disclosures

  • When required by law, subpoena, or valid legal process.
  • To protect the rights, property, or safety of FenceQuoter, our users, or the public.
  • In connection with a merger, acquisition, or sale of business assets, subject to standard confidentiality protections.

5. AI-Assisted Photo Analysis

When you upload photographs of your property, they are automatically analyzed by an AI system to identify the fence line, obstacles, and other details needed to generate your estimate. The analysis is performed by a third-party AI provider under a commercial agreement that prohibits the provider from using photographs you submit to train its models. The analysis identifies fence lines, obstacles, and site features. It does not perform facial recognition, and it does not collect, scan, capture, or store any biometric identifier.

Uploading a photograph is optional, and photographs improve the accuracy of your estimate. Please do not upload photographs showing people, license plates, or anything else you would not want sent to the Contractor you contacted.

6. Data Retention

We retain property photographs, lead data, and account information for as long as reasonably necessary to provide the Service, resolve disputes, enforce our agreements, and comply with legal obligations. Unless a longer period is required by law or is needed to resolve an actual dispute, we apply the following periods:

  • Property photographs: deleted 90 days after the estimate is generated, whether or not a booking results.
  • Estimate and lead data where no booking results: deleted 24 months after submission.
  • Estimate and lead data where a booking results: deleted 24 months after the appointment date.
  • Contractor account data: deleted 12 months after a subscription is canceled or lapses.
  • Billing and tax records: retained 7 years, as required for tax and accounting purposes.

Backup copies are overwritten on our ordinary backup cycle after data is deleted from active systems. Deleting your data from our systems does not delete any copy a Contractor separately retains.

7. Your Privacy Rights

Depending on where you live, you may have rights under state privacy laws, for example, Minnesota's Consumer Data Privacy Act, and comparable laws in California, Virginia, Colorado, and other states, to access, correct, delete, or obtain a copy of your personal information, and to opt out of certain uses. To submit a request, email support@fencequoter.app. We will respond within 45 days of receiving a request we can verify, and may extend that period by an additional 45 days where reasonably necessary, in which case we will tell you before the first period ends. We may need to verify your identity before acting on a request, and we will not charge you or treat you differently for making one.

If we decline your request, you may appeal by emailing support@fencequoter.app with “Appeal” in the subject line. We will respond to an appeal within 45 days, and if we deny it we will tell you how to contact your state attorney general.

We offer these rights to everyone who uses the Service, wherever they live, and whether or not a particular state privacy law applies to us.

8. Cookies and Similar Technologies

The Widget uses minimal, functional storage in your own browser (not a tracking cookie in the advertising sense) to remember your progress through the estimate steps if you accidentally refresh the page. This information stays in your browser and is not transmitted to or stored on our servers. Our hosting, mapping, and database providers may set cookies or similar identifiers that are necessary to load, secure, and operate the pages you visit. We do not currently use third-party advertising or cross-site tracking cookies. If that changes, we will update this Policy and, where required, obtain your consent first.

9. SMS/Text Messaging

This section applies to Contractor Accounts, not Widget Users. Contractors who opt in to SMS notifications receive text messages about new leads and bookings through the Service, sent via our SMS provider, Telnyx. Consent to receive text messages is not a condition of purchasing the Service. Message frequency varies with the number of leads and bookings an account receives. Message and data rates may apply. A Contractor may reply HELP for help, or STOP to opt out of further texts, consistent with standard carrier practice, and may also turn SMS notifications off in the dashboard or opt out by any other reasonable means, though doing so will limit their ability to receive timely lead notifications, which is a core feature of the paid Service. Carriers are not liable for delayed or undelivered messages.

We do not sell, rent, or share mobile phone numbers or SMS consent with any third party for that party's own marketing, and we do not use them to market to you.

10. Data Security

We use reasonable administrative, technical, and organizational measures designed to protect personal information, including encryption of data in transit and access controls restricting who can view stored data. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. Children's Privacy

The Service is intended for use by adult homeowners, property owners, and business personnel, and is not directed to children. We do not knowingly collect personal information from anyone under 18. If you believe a child has provided us with personal information, please contact us at support@fencequoter.app and we will delete it.

12. Changes to This Policy

We may update this Policy from time to time. If we make material changes, we will update the Effective Date above and, where appropriate, provide additional notice through the Service or by email to Contractor Accounts. We will not apply a materially different use to information we already collected without giving notice and, where required, obtaining consent.
